Missouri Education Watchdog: Special Needs Schooling Especially ...

The assault on parental responsibility and parental rights just keeps getting notched up. Parents of special needs children may have been in the trenches longer than anyone else, and the battle there is very fierce.? They know they need to be their child's advocate, but finding the line between being an advocate and being a pain in the b*** seems to be very difficult.? Unfortunately, at the end of the day the decisions appear to be made on the basis of money.? With falling school budgets and the tight economy, the battle for money has become intense, and the children are the ones losing.

Take the case of Chuka Chibuogwu and the Alief Independent School District in Houston, TX. Chuka has autism and was in middle school when his parents, immigrants to this country, began asking the district to give him the services they felt he needed and was entitled to. The following details come from MyFoxHouston.

"When I went there I saw things no mother would want to see," says Neka of her visits to Chuka's middle school.

"My wife went to observe, found him squashed in the corner and nobody cared," says Kenneth.

"There was nothing I could do but cry because I was so shocked that such a thing could go on in this country," added Neka of the repeated conferences with Alief administrators ending in stalemate."

The family spent most of their life savings on "due process" which resulted in a stalemate.? The Chibuogwus eventually took their son out of school and began home schooling him.? It would be a sad case if it ended there, but it didn't.? The school district turned around and sued the Chibuogwus for the cost of the due process to the district, at the time $170,000.

The story became even more egregious when it was revealed that none of the school board members of Alief were even aware of this legal effort.? It was all done as a deal between the Superintendent and a lawyer, Erik Nichols, who had promoted a legal seminar entitled ?Show Me the Money? ? a how-to guide for extracting cash penalties from parents who challenge their public schools.

FOX 26 News obtained invoices which show the district?s taxpayers have compensated Erik Nikols and his law firm Rogers, Morris and Grover as much as $12,000 in a single month for waging the three-and-a-half year courthouse campaign against the Chibuogwus. Ultimately the district spent over $200,000 going after this family who was trying to advocate for their son. Why?? Well once the Federal 5th Circuit court threw out the district's case ruling that the district had no legal right to collect money from the Chibuogwus, the district's next action shed light on the reason why they fought so hard.

In January the district demanded, as a condition of settlement, that Nneka and Kenneth Chibuogwu sign a pre-drafted apology. In it the Chibuogwus would have to admit their actions were ?reprehensible? and that they ?bullied? and ?harassed? teachers and staff. They would also have to confess they were coerced to attack the district by the news media and that Alief provided their son with all the educational support he needed.? In short, they wanted to humiliate these parents as a warning to other parents who might dare to advocate for their children. At the end of the day, the district felt they literally couldn't afford to set the precedent with this family about providing special needs services.? In order to stem the tide of demands from other parents, they had to show that, "you don't go up against the district."

This case is not isolated. A similar case worked its way through the Bethlehem PA school district.? The court once again ruled that the district had no right to receive compensation from the family seeking special ed services.? In this case, the facts begin to show the blurry line that currently exists between advocating and harassing.

"The school district sued Zhou in 2009, alleging she engaged in "vexatious" behavior by refusing to approve special education plans for her sons, identified by the initials M.Z. and J.Z. The suit alleged Zhou demanded a series of due process hearings for her sons between 2001 and 2009, allegedly walking out of one and refusing to participate in another.

Zhou also demanded the district pay for a Mandarin interpreter for her children at the special education meetings, even though the family speaks English, the suit says.

The district demanded damages under a provision of the federal Individuals with Disabilities Education Act that allows school districts to sue to recoup legal fees when it can show a parent has abused the system by requesting unnecessary or frivolous hearings." mcall.com

The Bethlehem District claimed the Zhou's purposely drove up the cost of their son's special education so that it would be more in line with the private academy they wanted the district to pay for. That's if you believe, as the district did, that the case was about money.

Such was not the case in Kansas City where a parent with a deaf child was seeking special education services for her child but was meeting with resistance from the district. In that case, having the district pay for tuition to a nearby school that specialized in educating deaf children would have meant a $5,000 savings to the district. Of course public school money is never that clear. Losing the special needs student would have impacted their costs for teachers already hired to provide special education who now had one less student to teach, even though those teachers did not have the special training necessary to deal with a deaf child who wanted to speak instead of use sign language. At the end of the day the district's actions were based more on money than ideology or concern for the student.

Those parents decided to move to a district that had a better school for the deaf that was affordable for the family. This decision reaffirmed the parents as the ultimate decision makers for the child and showed that they were able to make a decision that took into account the needs of the child as well as the realities of available funding.

It would be unfair not to take the school district's position into account as well in this battle. It would not be out of line to claim that every Special Education teacher knows of at least one instance (and maybe more) where parents have pushed for more than their child actually needed or was entitled to. Take the case of the child who came from the elementary school with an Individual Education Plan (IEP) for reading and writing. By the time this child reached middle school he was getting all A's in advanced classes, but the parents would not allow the district to drop his IEP and argued for every service they believed he needed. This meant that special ed teachers had to spend X number of minutes a day with a child who clearly did not need their services, at the expense of other children who did. Every district deals with these cases individually and worries about the precedents being set. Do they cave to the wishes of these parents because in the long run it will be easier and less expensive, or do they risk, by doing that, that other parents will seek similar services, stretching the available staff even further?

What motivates the parents?? Primarily it is concern for their children, but in some cases it is to game the system.

There is a misconception among parents with students who receive special services from public schools. A child who can maintain an IEP through high school may? get a special accommodations for the SAT or ACT,? which can include additional time, an alternate testing environment, and alternative ways to provide answers. These factors could improve their score.? For a child with mild cognitive impairment these accommodations could mean the difference between getting in to college or not.? That's quite an incentive for parents to push the system.? The reality, however, is that these accommodations are rarely granted by the ACT and SAT services. A child must be severely impaired to get extended time (e.g. reading at the 4th grade level in 10th grade). Meanwhile, children who have matured and learned to compensate for their disability are being told daily that they cannot do the work on their own.

When they enter college these kids are no longer covered under the Individuals with Disabilities Education Improvement Act of 2004 (IDEA) which means no more IEPs or guarantees to education. Instead they are considered an adult for whom education is an opportunity. They are covered only by accommodations provide by the Americans with Disabilities Act. ADA's impact on those with learning disabilities, ADHD, low spectrum Autism disorder and other things that could be accommodated in K-12 is limited so parents with special needs kids need to do a lot of research about the programs available for their son or daughter at the various institutions of higher learning.

Meanwhile our system struggles to find that line between being the only voice for your children and just being a big loudmouth.

Lost data may have exposed 800,000 people in Calif

(AP) ? A disaster preparedness exercise to ensure California's child support system could be run remotely went smoothly, except for one casualty: the names, Social Security numbers and other private records of about 800,000 adults and children.

Four computer storage devices for the California Department of Child Support Services went missing somewhere between Boulder, Colo., and Sacramento earlier this month while they were in the possession of IBM and Iron Mountain, Inc, the department announced Thursday.

The backup storage cartridges also contained addresses, driver's license numbers, names of health insurance providers and employers for custodial and non-custodial parents, and their children.

The cartridges had been sent to IBM's facility in Boulder as part of a disaster simulation, so the technology company could test whether it could run the state's child support system remotely, said Christine Lally, a spokeswoman for the state's Office of Technology Services.

After testing was completed successfully, the data cartridges were to be sent back to California. Typically, secure transportation for sensitive materials are provided to the state through Iron Mountain but the company doesn't fly, so FedEx transported the cartridges.

"We believe that the container was not properly secured, thus allowing the container to open and then spill out," Lally said.

IBM did not immediately respond to a call seeking comment.

The department has notified all those possibly affected by the March 12 data loss via mail, and has notified the three major credit reporting agencies, the state attorney general's office and the state Office of Privacy Protection.

The child support department is recommending that those affected by the breach place a fraud alert on their credit cards, get copies of their credit reports and take other appropriate steps to protect their identities.

The agency's interim director, Kathleen Hrepich, says the incident won't affect the processing of child support cases.

There's a chance the information from the California Department of Child Support Services won't be accessible because a specialized machine is needed to run the cartridges the data is stored on, and special hardware and software are needed to read it, said Lally.

"(A data cartridge) is definitely not something that you or I could just pop into our laptop," Lally said.

Thursday's announcement isn't the first time massive amounts of personal information entrusted to IBM has been lost.

Last March, IBM informed insurer Health Net that the company could not find drives containing information for 1.9 million enrollees. The lost information included financial information, Social Security numbers and health histories.

The state's contract with IBM for the disaster services contract began August 1, 2008, and expires July 31, 2012.

"Obviously, the California state agency picked IBM because it trusted its expertise in securing highly sensitive personal data," said Beth Givens, director of the Privacy Rights Clearinghouse.

"Unfortunately, we can't assume that our sensitive personal information is safeguarded to the extent that it should be," Givens said.

The San Diego-based organization tracks data breaches and estimates at least 550 million personal records have been breached since it began tracking them in 2005.

Gillmor Gang: Daddy, What?s Microsoft?

Gillmor Gang test patternThe Gillmor Gang ? Robert Scoble, John Taschek, Rob La Gesse, Kevin Marks, and Steve Gillmor ? rode out of Dodge and straight into an ambush. Well, no, but in service of the OverAggregator Lord here are our talking points: Microsoft trembles at the alter of irrelevance, Google doesn't get TV but may sneak into the tablet market by giving them away, and HTML5 still can't get a date. I snuck in the usual mentions of Mad Men and push notification, the first a reference to the return of the mesmerizing prequel to Seinfeld, and the second the technology that ensures that you don't have to watch the stream all day to stay up with what's going on. Combining delayed gratification theatre with premature notification will produce the next big hit of the iPad Age.

Sporting KC tops our MLS rankings

We?ve already dropped the knowledge and science on Parts II and III; here are your top money-makers and heart-breakers right now in MLS:

6. Chicago Fire ??Glass half-full: Four points of a possible six has the Fire on the very same bullet train track that Frank Klopas? crew finished on late last year. Glass half empty: This fearsome foursome of points came against expansion Montreal and a reeling Philadelphia Union. This week?s road test at Colorado will ?tell us more.

5. Houston Dynamo ??Odd match, last Friday in a 2-0 loss at Seattle. The Dynamo was in control in the hostile CenturyLink Field, and yet found themselves down by a pair inside the first half. Manager Dominic Kinnear said he was happy for things other than 10 minutes that went sideways. Still, all things considered, the Orange can be quite pleased with two wins from three matches on the road to start 2012.

4. Los Angeles Galaxy ??The big news out of AEG Valley last week was an announced friendly for this July against touring Tottenham Hotspur. The team had a week off; New England visits the Home Depot Center this week.

3. Real Salt Lake ??A disallowed goal for the home side in a 1-0 surprise setback has been a talker around MLS this week. A top MLS executive says referee Mark Kadlecik got it right. Still, questions linger about removing an attacking team?s advantage in such situations.

2. Seattle Sounders ??Whether you think David Estrada?s deflected strike should be marked down as ?own goal? or ?another one for the kid,? Seattle?s young man is clearly brimming with confidence. Same with the team, tied with Vancouver atop the Western Conference table with San Jose making the northern hop this weekend. The keen eye of Seattle Times? writer Joshua Mayers was particularly high last week on Marc Burch, who seems to be establishing himself as Sigi Schmid?s top choice left back.

1. Sporting Kansas City ??The Kansas City Star?s Charles Gooch has some deliciously revealing numbers on the stacked-and-packed attack at Livestrong. For example, Sporting KC has outshot each opponent this season by a double-digit margin: plus-16 vs. D.C. United, plus-10 vs. New England and plus-10 in Sunday?s win over FC Dallas. So it?s not just that Peter Vermes? men are a perfect 9 of 9 from possible points this year; the Midwest side is seriously pressing the opposition. Chivas USA is up this week in Southern California.

Equilateral Media tell us all about their start-up process & give ...

Equilateral is a Leeds-based non-profit social enterprise providing training, mentorship and advice to 13-25 year olds interested in electronic music or multimedia design, focusing on young people to whom such activities are usually unavailable or to those who would benefit from engaging in such creative activities both personally and socially. This is provided through: workshops, skills-based learning, seminars, creative careers advice, and an online zone providing coverage of Leeds? creative scenes.

http://www.equilateralmedia.co.uk

What inspired you to start your own business?

Equilateral was founded after the four us had been through government employment schemes (e.g. Future Jobs Fund) but subsequently still found it difficult to find anything more than occasional or part-time work in our fields. We found that we were becoming reliant on other people sourcing projects that we could work on, so we decided to create our own. The inspiration really came when we realised that we could pool our expertise and create something we all really care about. Further to that is the drive each of us has to do something good with our careers, helping others and ourselves. We have no prior business experience, but we all know what we want to achieve and enjoy learning as we get there.

How did you begin your business venture? What help did you receive?

The idea to bring a group together for a new venture was discussed many times over a few months. There came a day when we were all together and finally decided that we were going to make a go of it and by the end of the month we were incorporated. We have had help from a number of sources. A mentor who has helped get the company articles together and meets with us periodically to objectively assess where we are both personally and professionally. We have had several meetings with a mentor from the Chamber of Commerce to help us with our business plan, and of course we have met several times with Business Start-Up at Leeds Met. All of this advice has helped Equilateral grow much quicker than we could have done without.

What are your top tips for running your own business?

?It is still early days for us and we are constantly learning but what immediately comes to mind is the following: Talk to people. Business advisors, potential partners, potential clients will all have something to say and could help you focus your company in the direction it needs to go.

Always be learning and developing your ideas. In our work especially, we have found that it is important to stay ahead of trends as much as we can and develop our business to meet the demand.

Lastly, give it a go. Quite self-explanatory.

?If you could have done things differently, what would you have changed?

?Not much, there are things that could have been done differently, but those things have been an important part of the learning process for us.

?What has been your biggest challenge?

?No start-up capital has been difficult. We mainly provide services that can be carried out in community facilities but, even so, getting the initial money together for bits and pieces has been a challenge.

?What has been your biggest mistake?

?Wanting to set off with the creative and fun elements from the get go. It?s maybe not so much of a mistake, but we did shy away from getting the fundamental business aspects in place early on. We have of course covered this now, but it can mean a day of paperwork here and there which can get in the way of other work now we are trading.

?What do you see as your greatest achievement?

?To date our biggest achievement has been receiving acknowledgement that what we are trying to do is a good thing and that we are making good progress with it. Of course that has been made no clearer than winning the Business Concept Competition, a boost that has really helped push us forward.

?What advice would you give to students thinking of starting their own business?

?Seek advice. There are a lot of places you can go and talk to someone with years of experience, from concept of your idea right through to trading and beyond. Even if I had a background in business I would have still accessed as much advice as I could ? even so much as just a nod that you are on the right track.

?Also, checking back to our ?biggest mistake?, I would say get the groundwork in place for the business early. It seems obvious but it is easy to overlook the simple tasks that can give you a steady base for your business, whatever sector you are in.

Photos of asteroid Vesta reveal bright, ancient rock and dark, melted stone

The new photos of Vesta from NASA's Dawn spacecraft highlight odd, shiny spots that are nearly twice as bright as other parts of the asteroid ? suggesting it is original material left over from the space rock's birth 4 billion years ago, NASA officials said today.

A NASA spacecraft orbiting the huge asteroid Vesta has snapped amazing new photos of the colossal space rock, images that reveal strange features never-before-seen on an asteroid, scientists say.

The?new photos of Vesta?from NASA's Dawn spacecraft highlight odd, shiny spots that are nearly twice as bright as other parts of the asteroid ? suggesting it is original material left over from the space rock's birth 4 billion years ago, NASA officials said today (March 21).

With a width of about 330 miles (530 km),?asteroid Vesta?is one of the largest and brightest objects in the main asteroid belt between the orbits of Mars and Jupiter. NASA's Dawn probe has been orbiting Vesta since 2011 to study the space rock in unprecedented detail.

"Our analysis finds this bright material originates from Vesta and has undergone little change since the formation of Vesta over 4 billion years ago," said Jian-Yang Li, a Dawn participating scientist at the University of Maryland, College Park, in a statement. "We're eager to learn more about what minerals make up this material and how the present Vesta surface came to be."

Asteroid Vesta unveiled

Li and his colleagues unveiled Dawn's new views of Vesta today at the 43rd Lunar and Planetary Science Conference in The Woodlands, Texas.

The photos show surprisingly bright spots all over Vesta, with the most predominant ones located inside or around the asteroid's many craters. The bright areas range from large spots (around several hundred feet across) to simply huge, with some stretching across 10 miles (16 kilometers) of terrain. [Video: Vesta ? Asteroid or Dwarf Planet?]

"Dawn's ambitious exploration of Vesta has been going beautifully," said Marc Rayman, Dawn chief engineer at NASA's Jet Propulsion Laboratory in Pasadena, Calif., which oversees the mission. "As we continue to gather a bounty of data, it is thrilling to reveal fascinating alien landscapes."?

Dawn mission scientists suspect the bright patches on Vesta were exposed during violent collisions with other space rocks. These impacts may have spread the bright material across the asteroid and mixed it together with darker material onVesta's surface, researchers said.

Astronomers have known about variations in Vesta's brightness for some time. Photos taken by the Hubble Space Telescope before Dawn arrived at the asteroid also revealed the bright patches.

Never-before seen asteroid melt

But only the close-up photos from the Dawn probe have revealed the surprising variety of dark blotches on Vesta, which appear as dark gray, brown or reddish blemishes, NASA officials said.

In some views, these darker spots are small deposits near impact craters, while in other photos they appear in larger concentrations. These darker spots on Vesta may also be the result of collisions on the?asteroid, researchers said.

Slow carbon-rich asteroids may have created some of the smaller dark material deposits without carving out a big crater. Meanwhile, faster objects may have potentially slammed into Vesta so hard they melted the big asteroid's crust, which could have also created the dark spots.

"Some of these past collisions were so intense they melted the surface," said Brett Denevi, a Dawn participating scientist at the Johns Hopkins University Applied Physics Laboratory in Laurel, Md. "Dawn's ability to image the melt marks a unique find. Melting events like these were suspected, but never before seen on an asteroid."

NASA launched the $466 million?Dawn spacecraft?in 2007 and Vesta is only the first stop of the spacecraft's two-asteroid tour. Dawn arrived at Vesta in July 2011 and is expected to spend about a year there before heading off to its next target ? the even larger asteroid Ceres, which is also classified as a dwarf planet.

Dawn is expected to arrive at Ceres in February 2015.

Watson lends a helping hand to cancer research, partners with Memorial Sloan-Kettering

Image
Supercomputers at the forefront of medical practice? The notion is by no means a stretch of the imagination. Yet, research of this kind mostly goes unnoticed -- that is, unless the computational wizardry handholding these advancements belongs to Jeopardy!'s AI king. That's right, Watson, IBM's bold-face named powerhouse of silicon wizardry, will be made available as a development tool for oncologists at Memorial Sloan-Kettering to deliver "individualized cancer diagnostic and treatment recommendations" derived from the center's case note database. Drawing upon that raw processing power, field practitioners will purportedly have access to a wealth of the latest therapeutic advances which would, normally, take too long to spread outside of specialized facilities. The agreement is not the first of its kind, as this time last year IBM had announced a similar partnership with Columbia University, although no further news has come from that union. MSKCC, for its part, does have concrete plans to move its small pilot program forward, with a target launch set for later this year and plans to expand the project's reach by end of 2013. Jump past the break for the official presser.

French gunman: I was planning more attacks, with outside funds

Police say Mohammed Merah, the gunman responsible for killing three soldiers, a rabbi, and three schoolchildren, made an early morning phone call to France 24 to talk about his motives.

Intensive sleuthing, videotape, a scooter repairman, and apparent good fortune helped French police apprehend a serial killer hours before he said he planned to kill again.

Mohammed Merah, a 24-year-old Algerian who claims ties to Al Qaeda, found himself under siege in a Toulouse apartment at 5:40 a.m. today, only hours after phoning a French television news station to give a concise and clear explanation for his decision to kill seven people, including three children, and to reveal that he planned similar operations in cities across France. ?

France, which was in a state of apprehension yesterday over an elusive unidentified killer and on its highest state of alert (scarlet), now has not only had several relatives and friends of Mr. Merah under detention, but also volumes of information and motives about the suspect, who was still engaged in a standoff with police as of press time. His?mother, two brothers, a friend, and a girlfriend are all under police custody.

Merah told TV news station France 24 he was allied with Al Qaeda and upholding the honor of his Islamic faith. He also said the killing of the three paratroopers and four Jewish individuals was "necessary? and that he planned to do similar acts in Toulouse again, as well as Paris, Marseilles, and Lyon, according to Ebba Kalondo, the night editor at France 24 who took the call, made from a phone booth at 1 a.m.?

?He wanted to qualify some of the details about the bullet casings,? said Ms. Kalondo. He told the editor he would have acted earlier but funding for his attacks ?? ?from inside and outside France? ??only recently became available. The funding was for an?assortment of weapons and other operational necessities, he said.

French Interior Minister Claude Gueant told reporters in a press conference today that Merah was identified on March 19, the day of the shooting, by tracking an IP address he used to purchase a scooter from the first victim, a French paratrooper named Imad Ibn-Ziater. But Paris prosecutor Fran?ois Molins said Merah's actual whereabouts ? a Toulouse apartment less than two miles from the Jewish school he terrorized ? were not discovered until yesterday.

Prosecutors painted a picture of a man who had a violent personality and ?mental disorders as a minor.? Merah moved around, living in several different places, and is ?of modest means? he can rent by the month and has several places to stay,? Mr. Molins said. Video analysis of his actions at the Jewish school two days ago helped police identify him, implying they may have consulted violent offenders lists. Molins said the young man would stay alone in his room for long periods of time and watched grisly martyrdom films.?

The police achieved a break in the case when they checked lists of French citizens who visited Afghanistan and Pakistan, which Merah had done, three times evidently, and investigators cross checked it with lists of young French known to have jihadi sentiments or identified with violent mujahideen actions.

Another major break in the case came when a scooter repairman reported to police that a man entered his shop, asking whether a spray paint job on a scooter would demobilize the scooter tracking system and where the tracker was. The repairman refused to give the latter information and phoned authorities, according to Molins, the prosecutor. ?

Authorities initially reported that Merah had a cache of explosives in his car but could not confirm this during the press conference. They said they found a car with four weapons, including an Uzi and a pump-action rifle, and that they also tracked down the scooter and helmet used in the attacks.?

The prosecutor said Merah ?doesn?t have the soul of a martyr, but wants to kill and stay alive,? although he told France 24 there were only two ways he would stop killing: ?prison, where he could hold his head up high,? or death.

The prosecutor?s general picture of Merah clashed with the tone of the man who called France 24, although French authorities say Merah has confirmed that he had the conversation. Kalondo said that on the phone Merah was calm, "extremely well-spoken ... very polite ... used no strong language ... was unruffled and sure of himself.?

"He said he wanted to avenge his brothers and sisters in Palestine" and was angered by the French law banning the wearing of the burqa, the full-length veil worn by some Muslim women, in public.

Hypertension 101 ? Safe Remedies Like Natural Blood Pressure ...

Coenzyme Q10 (or CoQ10) ? There are evidences that a supplement of CoQ10 can support lower blood pressure levels.

Garlic ? Supplements created of garlic must be supervised by a qualified health care practitioner. Garlic has a blood thinning capacity that will reduce blood?s ability to form a blood clot, just like an aspirin. Garlic may also interact with other ?blood thinners? supplements like warfarin, pentoxifylline, vitamin E, aspirin, and gingko. For person who has to undergo or have undergone a surgery, it can be advised to stop taking a garlic supplement in a number of weeks before and soon after.

Hawthorn ? The hawthorn has been used as a traditional medicine as a cure for hypertension. It is very good because there were no reported reports of side effects and drug or supplement interactions. This supplement is very safe to use and effective as well.

Fish Oil ? Fish oils is the healthiest technique to lower high blood pressure levels. Though supplements with fish oil contain both the DHA (docohexaconic acid) and EPA (eicosapentaenoic acid), you will discover plenty of evidences that DHA have the capability to lower high blood pressure levels.

Folic Acid ? Folate is a type of B vitamin which plays an important role in the formation of RBCs (red blood cells). It also facilitates in lowering down high blood pressure levels in most people by the reduction in the elevation of homocysteine levels.

Life style modification along with a few natural or homemade remedies can quickly control high blood pressure levels. Your physician could possibly also suggest some medicines to lower your high blood pressure levels. It is necessary to have correct coordination together with your physician mainly because unmanaged high blood pressure could lead into organ harm and may well enhance the risk for a heart attack, brain hemorrhage, stroke,, vision loss and kidney disease.

Current in Carmel ? Health insurance

It is our position misplaced, overblown patriotic rhetoric smothers intelligent discussion. Sen. Dan Coats? defense of the Respect for Conscience Amendment on religious freedom grounds is an excellent example. Search YouTube for ?Coats says we must stand for religious freedom.?

The Respect for Conscience Amendment, defeated by Democrats in the Senate on March 1, would have allowed any employer (not just faith-based organizations) that offers health insurance to refuse to cover any ?specific item or service contrary to the (employer?s) religious beliefs or moral convictions.? This amendment is caught up in the brouhaha about health insurance for contraceptives ? subject for another editorial.

Our point is different. We object to Coats? ?religious freedom? rhetoric because it obscures permitting employers to deny insurance coverage for items contrary to the employer?s religious beliefs or moral convictions does nothing to protect the religious freedom of living, breathing human beings. Search as you might in Coats? grandiloquent tribute to freedom of religion; you won?t find a single syllable explaining how the Respect for Conscience Amendment would enhance the religious freedom of actual, real-life people.

We welcome thoughtful discussion about what treatments employer health care plans must cover. But Coats wrapping himself in the flag certainly doesn?t lead to such a discussion.

New article offers a diagnosis, unveils its causes, and prescribes a humanizing cure

"Anyone who has been admitted into a hospital or undergone a procedure, even if cared for in the most appropriate way, can feel as though they were treated like an animal or object," says Harvard University psychologist and physician Omar Sultan Haque. Health care workers enter their professions to help people; research shows that empathic, humane care improves outcomes. Yet dehumanization is endemic. The results can be disastrous: neglect of necessary treatments or prescription of excessive, painful procedures or dangerous drugs.

What are the causes and effects of dehumanization in medicine? And what can be done about it? In Perspectives in Psychological Science, a journal of the Association for Psychological Science, Haque and co-author Adam Waytz at the Kellogg School of Management of Northwestern University synthesize diverse literatures to distinguish when dehumanization is useful from when it is not. Then they recommend "simple, cheap, and effective" changes to "make medical institutions more humane and ethical, as well as efficacious in the service of improved health," says Haque.

The structures of institutions and the psychological demands of providing care can cause professionals to treat patients as less than human. "Deindividuation"doctors as a sea of white coats; patients as half-naked bodies in smocks, identified by their disease or procedure ("the gallbladder in Room 38")allows staffs to avoid taking responsibility for each patient. "Impaired patient agency" refers to medical staffs' treatment of patients as incapable of planning their own care, which is both infantilizing and demoralizing. "Dissimilarity"hierarchies of power, differences of race, class, and gender between staff and patientshave roots outside the hospital. Nevertheless, they cause miscommunication and alienation, even maltreatment. None of these practices serves good medical care.

More complex are dehumanizing practices that may aid care. Diagnosis and treatment might necessitate "mechanization"breaking the body into organs and systems. Scaling back empathy can diminish staff stress and burnout. Even moral disengagement can be adaptive. From giving a shot to slicing into the flesh to perform surgery, medical care often requires inflicting pain or invading the boundaries of the body in violation of deeply held human taboos. And patients may die after even the best of care. For the professional, guilt could be paralyzing.

Still, the authors argue, dehumanization is useful only in "specific contexts," such as acute care. Waytz says, "Dehumanization's functionality varies wildly across specialities from pediatrics to orthopedic surgery, so future research is needed to determine when dehumanization is most prevalent and most detrimental." In the meantime, the authors offer numerous humanizing fixes: Call patients by name, not numbers; discourage labeling people as diseases; personalize hospital rounds and pre-surgical preparation; eliminate opaque surgical masks; affix photos to CT scans and biopsies. Include patients in care planning. Let them choose their gownsand design those gowns so they're no so humiliating. Increase physician diversity and hire people with good social skills. And, for med schools, perhaps most radical: Eliminate the "white-coat ceremony" when graduates don the mufti of the elect.

Finally, "we should train medical professionals to think of themselves as mortal sharing a common humanity and vulnerability with their patients," says Haque. Although dehumanization can be useful, "even functional dehumanization should be viewed like a potent, salutary, but dangerous drug that can have disastrous side-effects" when overprescribed.
